Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Homy (“Company”, “we”, “our”, or “us”) governing your access to and use of the Homy website, mobile application, and real estate services (collectively, the “Platform”).

By accessing or using our Platform, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, you must not access or use our Platform.

Scope of Services

Homy is an online real estate platform that connects buyers, sellers, landlords, and tenants with verified property listings and licensed real estate agents across the USA, UK, Canada, and Australia. We act as a marketplace and do not directly participate in any real estate transaction unless explicitly stated.

User Accounts

Account Registration

To access certain features of the Platform, you must create an account. When registering, you agree to provide accurate, current, and complete information and to keep your account information updated at all times.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us of any unauthorised use of your account at security@homy .com. Homy will not be liable for any loss or damage arising from your failure to safeguard your account.

Account Types

•        Buyer/Renter Account — Free access to search listings, save properties, and contact agents.

•        Seller/Landlord Account — Ability to list properties, manage enquiries, and access analytics.

•        Agent Account — Professional profile, lead management tools, and featured placement options.

Property Listings

Accuracy of Listings

All property listings on Homy are provided by sellers, landlords, and agents. While we make reasonable efforts to verify listing information, we do not guarantee the accuracy, completeness, or reliability of any listing. Users are advised to conduct their own due diligence before entering into any property transaction.

Listing Standards

All users who submit property listings agree that their listings will:

•        Contain accurate and truthful information about the property

•        Include only photos and descriptions of the actual property being listed

•        Not contain misleading, fraudulent, or discriminatory content

•        Comply with all applicable local laws, including fair housing regulations

•        Be removed or updated promptly when the property is no longer available

Listing Removal

Homy reserves the right to remove any listing that violates these standards, contains inaccurate information, or is reported by users as fraudulent. Repeat violations may result in account suspension or termination.

Acceptable Use

Permitted Use

You may use the Homy Platform for lawful, personal, and commercial real estate purposes in accordance with these Terms. This includes searching for properties, contacting agents, saving listings, and listing properties for sale or rent.

Prohibited Activities

You agree not to engage in any of the following activities:

•        Posting false, misleading, or fraudulent listings or reviews

•        Scraping, harvesting, or systematically downloading content from our Platform

•        Using automated tools, bots, or scripts to access our Platform without written consent

•        Attempting to gain unauthorised access to our systems or other users’ accounts

•        Engaging in discriminatory practices in violation of fair housing laws

•        Circumventing our platform to avoid fees or facilitate off-platform transactions

•        Uploading viruses, malware, or any malicious code

•        Harassing, threatening, or abusing other users or our staff

Intellectual Property

Our Content

The Homy Platform, including its design, layout, logos, graphics, text, and software, is owned by Homy and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of our Platform without our prior written consent.

User Content

By submitting content to our Platform (including property photos, descriptions, and reviews), you grant Homy a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute that content in connection with operating and promoting the Platform. You represent that you own or have the right to submit all content you post.

Framer Template Notice

This website is built on a Homy Framer template available on the Framer Marketplace. Purchasers of this template are licensed to use it for their own real estate business. Reselling, redistributing, or sub-licensing this template to third parties is strictly prohibited without written permission from the template creator.

No Real Estate Advice

The content on Homy is for general informational purposes only and does not constitute professional real estate, legal, financial, or investment advice. Platform Availability

We do not guarantee that the Platform will be available at all times. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

Market Data

Any property valuations, price estimates, or market data provided on our Platform are for informational purposes only and may not reflect actual market conditions. Homy makes no representations as to the accuracy or completeness of such data.

Limitation of Liability

To the maximum extent permitted by applicable law, Homy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from:

•        Your use of or inability to use the Platform

•        Any property transaction entered into through the Platform

•        Unauthorised access to or alteration of your data

•        Statements or conduct of any third party on the Platform

•        Any other matter related to the Platform

Our total liability to you for any claim arising from these Terms shall not exceed the amount paid by you to Homy in the 12 months preceding the claim, or $100 USD, whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless Homy and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any rights of another person or entity.

Termination

By You

You may delete your account and stop using the Platform at any time by visiting your account settings or contacting us at hello@homy.com.

By Homy

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, Homy, or third parties, or for any other reason.

Effect of Termination

Upon termination, your right to use the Platform will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will remain in effect.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law provisions. For users in the UK, EU, Canada, or Australia, mandatory local consumer protection laws may apply in addition to these Terms.

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in New York, NY, unless mandatory local law requires otherwise.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by updating the “Last Updated” date at the top of this page and, where appropriate, by sending an email to the address associated with your account. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
